CLIENT TERMS & POLICIES

These Terms apply to personal training and related services provided by Petros Sklias, trading as Brighton Biomechanics (BTN-BMC) (“Brighton Biomechanics”, “we”, “us”).

By purchasing or participating in training with Brighton Biomechanics, you agree to these Terms.

1. Scope of Services

Brighton Biomechanics provides personal training, movement assessment, exercise programming and instruction using the Functional Patterns (FP) methodology.

Our practitioners provide exercise and movement coaching. Unless a practitioner separately holds an appropriate healthcare qualification and is acting specifically within that role, our services do not constitute medical diagnosis, physiotherapy, medical treatment, psychotherapy or other healthcare treatment.

No particular physical, medical, performance or aesthetic outcome can be guaranteed.

2. Medical Disclaimer & Client Responsibilities

You must not rely on information provided by a Brighton Biomechanics practitioner as an alternative to advice from your doctor or another appropriately qualified healthcare professional.

If you have questions or concerns regarding a medical condition, injury, medication or your suitability for exercise, you should consult an appropriate healthcare professional.

You agree to:

  • provide accurate and relevant information about your health, injuries and medical history;

  • inform your practitioner of any material change to your health or physical condition;

  • follow reasonable safety instructions; and

  • immediately inform your practitioner if you experience unusual pain, dizziness, shortness of breath, loss of balance or other concerning symptoms during training.

Brighton Biomechanics may modify, postpone or decline training where we reasonably believe that continuing would be unsafe, and may request medical clearance where appropriate.

You should never delay seeking medical advice, disregard medical advice or discontinue prescribed medical treatment because of information provided during training.

3. Exercise Risk & Liability

Physical exercise carries inherent risks, including the possibility of injury.

Brighton Biomechanics will provide its services with reasonable care and skill. You remain responsible for communicating relevant health information and for following the instructions given to you during training.

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, or your statutory consumer rights.

4. Professional Boundaries & Physical Contact

Functional Patterns coaching focuses on assessment, exercise programming and movement instruction.

Functional Patterns practitioners do not provide massage, manual therapy or practitioner-administered myofascial release as part of FP training. Where myofascial release techniques are used, clients will be instructed in how to apply these techniques themselves using appropriate equipment.

Where appropriate, a practitioner may use minimal professional tactile cueing on non-sensitive areas of the body to assist with positioning, posture or movement.

You may ask your practitioner not to use tactile cueing at any time.

5. Bookings & Payment

Training is normally booked in monthly blocks and prepaid in advance.

The price, number of sessions and applicable training period will be confirmed before payment.

Sessions within a monthly block are intended to be used during the calendar month for which they were purchased and will ordinarily expire at the end of that month.

Where exceptional circumstances such as significant illness or injury prevent attendance, please contact Brighton Biomechanics as soon as reasonably possible. Extensions may be granted at our reasonable discretion.

Sessions cancelled by Brighton Biomechanics will not expire as a result of our cancellation.

6. Client Cancellations

Brighton Biomechanics operates a 24-hour cancellation policy.

Cancellations or requests to reschedule must be made at least 24 hours before the scheduled session.

Where less than 24 hours' notice is given, or where a client does not attend, the session will normally be treated as used and will not be credited or refunded.

Brighton Biomechanics may waive this requirement in exceptional circumstances at its reasonable discretion.

This policy does not affect your statutory consumer rights.

7. Communications & Practitioner Availability

Brighton Biomechanics practitioners are not required to respond to telephone calls, emails, messages or other communications outside their published working hours, which are available on the Brighton Biomechanics website.

Messages received outside those hours will normally be dealt with during the practitioner's next working period.

Practitioners may choose to respond outside their normal working hours at their own discretion. Doing so does not create an obligation or expectation that they will remain available outside working hours on future occasions.

For the purposes of the 24-hour cancellation policy, a cancellation or rescheduling request sent through an accepted Brighton Biomechanics communication channel will be treated as received at the time it was sent, even if it is not read until the practitioner's next working period.

Brighton Biomechanics practitioners do not provide an emergency or out-of-hours medical service. Where urgent medical attention is required, clients should contact an appropriate healthcare or emergency service.

8. Late Arrival

If you arrive late, your session will normally still finish at the originally scheduled time and the full session fee will remain payable.

Where lateness makes it unsafe or impractical to conduct the session, the session may be treated as a late cancellation.

9. Cancellations by Brighton Biomechanics

If Brighton Biomechanics cancels a session, we will offer to rearrange or credit the affected session.

Where an appropriate replacement cannot reasonably be provided, the affected session will be refunded.

10. Refunds & Statutory Cancellation Rights

Payments for sessions already supplied are not refundable except where required by law.

Where you purchase services online, by telephone or otherwise at a distance or off-premises, you may have a statutory right to cancel your contract within 14 days of entering into it.

If you expressly request that training begins during this 14-day period and subsequently exercise your right to cancel, you may be required to pay a proportionate amount for services already provided.

Where services have been fully performed during the cancellation period following your express request and the legally required acknowledgement, your statutory cancellation right may end.

Nothing in these Terms removes or restricts any rights you have under UK consumer law.

11. Data Protection & Health Information

Brighton Biomechanics processes personal information in accordance with applicable UK data protection law, including the UK GDPR and Data Protection Act.

Because effective and safe personal training may require information about injuries, medical history or health conditions, we may process special-category health data.

We will only collect and use information reasonably required to provide and administer our services, maintain appropriate records, comply with legal or insurance obligations, and protect the health and safety of our clients.

Information may be disclosed where reasonably necessary to trusted service providers acting on our behalf, professional advisers, insurers, or where disclosure is required by law.

Your information will not be sold to third parties.

12. Functional Patterns & Intellectual Property

Brighton Biomechanics practitioners are independently qualified Functional Patterns practitioners who use Functional Patterns methodology subject to the applicable FP licensing and practitioner requirements.

Functional Patterns LLC is not a party to your personal training agreement with Brighton Biomechanics. Brighton Biomechanics and its practitioners are independent from Functional Patterns LLC and do not have authority to act as its agents or bind it contractually.

Functional Patterns techniques, educational materials, proprietary methods and other FP intellectual property remain the property of Functional Patterns and/or their respective rights holders.

Any instructional material, recordings or techniques provided during training are provided for your personal use only. Unless expressly authorised, they must not be reproduced, taught, sold, distributed, published or shared publicly, including through social media.

Where you use Functional Patterns' own website, application, products or services, the applicable Functional Patterns policies may also apply directly to that use:

Where required by Functional Patterns practitioner rules, you may also be required to accept a separate Functional Patterns Non-Disclosure Agreement (NDA) before training can begin.

13. Photography, Video & Recordings

Photography or video may occasionally be useful for movement assessment, technique review or tracking progress.

Brighton Biomechanics will not publish identifiable photographs, videos, testimonials or other client material for advertising, social media or promotional purposes without the client's separate consent.

Where clients are permitted to record instructional material during sessions, such material is for personal educational use only and remains subject to the intellectual-property provisions above.

Consent for public use of photographs or video is optional and is not a condition of receiving training.

14. Conduct & Safety

Clients and practitioners are expected to behave respectfully and professionally.

Brighton Biomechanics may refuse, suspend or terminate training where there is:

  • threatening, abusive, discriminatory or sexually inappropriate behaviour;

  • deliberate disregard of safety instructions;

  • behaviour that places the client, practitioner or another person at unreasonable risk;

  • persistent non-payment; or

  • another serious breach of these Terms.

Any unused prepaid services following termination will be dealt with fairly according to the circumstances and applicable consumer law.

15. Clients Under 18

Clients under the age of 18 must have the consent of a parent or legal guardian before training.

The parent or legal guardian must accept these Terms on behalf of the client and may be required to complete additional safeguarding or consent documentation.

16. Complaints

If you are unhappy with any aspect of our service, please contact Brighton Biomechanics at contact@btn-bmc.co.uk.

We will aim to investigate and resolve complaints fairly and within a reasonable time.

17. Changes to These Terms

Brighton Biomechanics may update these Terms where reasonably necessary, including to reflect changes in law, business operations or Functional Patterns practitioner requirements.

Changes will not retrospectively remove rights relating to services already purchased.

The version applicable to your training will be made available to you and identified by its effective date.

18. Governing Law

These Terms are governed by the laws of England and Wales.

Nothing in this section deprives a consumer of any mandatory legal protections or rights available to them under applicable law.
